Rest & Digest | Acid Reflux

This agreement is a legally binding agreement between you and Scott Rower, PhD, Licensed Psychologist ("Scott Rower," "we," "us," "our") and governs your purchase and use of the Rest & Digest Acid Reflux audio program (the "Program"). The Program is made available through restanddigest.org and Hello Audio (collectively, "the Platform").

Please read these terms carefully before purchasing. By completing your purchase you confirm that you have read, understood and agreed to these terms.

1. Nature of the Program

The Program is an educational audio program designed to teach diaphragmatic breathing and provide psychoeducation about the gut-brain connection as it relates to reflux symptoms. It is intended for general informational and educational purposes only.

The Program does not constitute the practice of medicine, psychology, or any other professional healthcare service. No doctor-patient or psychologist-client relationship is formed through your purchase or use of the Program. The information contained in the Program is not intended to diagnose, treat, cure, or prevent any medical or psychological condition and is not a substitute for professional medical or psychological care.

Use of the Program is at your own risk. Always seek the guidance of your physician or qualified healthcare provider regarding any medical condition, including decisions about medication. Do not disregard or delay seeking professional medical advice based on anything contained in this Program.

If you are experiencing symptoms that are new, rapidly worsening, or significantly different from your usual pattern — including difficulty swallowing, unexplained weight loss, vomiting blood, black or tarry stools, or chest pain — please consult your doctor before using this Program.

2. Eligibility

By purchasing the Program you confirm that you are 18 years of age or older and that all registration information you provide is accurate and complete.

3. Price and Payment

The Program is available for a one-time purchase at the price listed on the purchase page at the time of your transaction. All prices are listed in US dollars and are inclusive of applicable taxes where required.

Payments are processed securely through Stripe. We do not store credit card details. By completing your purchase you represent that you are the authorized holder of the payment method used.

We reserve the right to change the Program price at any time. Any price change will apply only to future purchases and will not affect completed transactions.

4. Access and License

Upon purchase you will receive a private podcast feed link providing access to all Program content. You are granted a personal, non-transferable, non-commercial license to access and use the Program for your own personal use only.

You may not share your access link, redistribute Program content, reproduce or transmit any portion of the Program in any form, or use Program content for commercial purposes without prior written consent from Scott Rower.

Access to the Program is lifetime for personal use. Scott Rower will make reasonable efforts to maintain Program availability but cannot guarantee uninterrupted access due to technical difficulties or circumstances beyond our reasonable control.

5. Refund Policy

If you are not finding the Program helpful, you may request a full refund within 30 days of your purchase date. To request a refund, email scott@scottrowerphd.com with your name, email and date of purchase. Refunds will be processed within 30 days of approval and returned to the original payment method. Upon refund your access to the Program will be discontinued.

6. Intellectual Property

All Program content including audio recordings, written materials, and associated graphics are the intellectual property of Scott Rower and are protected by US and international copyright law. You may not reproduce, distribute, modify, create derivative works from, or publicly display any Program content without prior written consent.

7. Health and Safety

You are strongly encouraged to consult with your physician or qualified healthcare provider before beginning this Program, particularly if you have been diagnosed with any medical condition or are currently taking prescription medication. Nothing in this Program should be used as a reason to delay seeking medical attention or to discontinue prescribed medication without medical supervision.

8. No Warranty

The Program is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Scott Rower makes no warranty, express or implied, as to the accuracy, completeness, fitness for a particular purpose, or results of the Program. Individual results vary and are not guaranteed.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Scott Rower shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the Program. In no event shall Scott Rower's total liability exceed the purchase price paid for the Program.

Nothing in these terms excludes liability for death or personal injury arising from negligence, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

10. Governing Law

These terms are governed by the laws of the State of Oregon. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Oregon.

11. Changes to These Terms

Scott Rower reserves the right to update these terms at any time. Updated terms will be posted on restanddigest.org. Your continued use of the Program following any update constitutes acceptance of the revised terms.
